McAndrews Attorneys Recognized by Managing Intellectual Property Magazine in First-Ever “IP Stars” Listing

CHICAGO, IL – May 23, 2013 – McAndrews, Held & Malloy, Ltd. announced today that four of the firm’s attorneys have been named “IP Stars” by Managing Intellectual Propertymagazine. Founding partner and Chairman Timothy J. Malloy, and shareholders Herbert D. Hart III, Greg Vogler and George Wheeler were recommended by their peers and clients for the first-ever ranking, which highlights the country’s leading intellectual property attorneys.
To be included as an IP Star, attorneys must receive a significant number of nominations from both peers and clients. The rankings are also based on extensive research among thousands of IP practitioners conducted by a team of researchers at Managing Intellectual Property. The attorneys included in the inaugural IP Stars listing are featured in the 2013 edition of the annual Managing Intellectual Property IP Handbook.
Nationally recognized for his intellectual property litigation successes, Timothy J. Malloyhas been involved in numerous multi-million-dollar verdicts, awards and settlements, and has served as lead counsel in trials throughout the country. His professional highlights include arguing before the U.S. Supreme Court on behalf of Eli Lilly and Company, the leading case directed to the scope of patent protection for medical devices. Malloy has been listed in the Best Lawyers guide every year since 1999, and is a Fellow of the Litigation Counsel of America, an honorary society of trial lawyers comprised of less than one-half of one percent of all American lawyers. As an IP Star, Malloy is recognized for his experience and knowledge in IP litigation, trade secrets, unfair competition and antitrust matters in the electronic and electrical equipment, healthcare equipment and services, medical devices, and technology hardware and equipment industries.
Herbert D. Hart III has significant experience in litigation before the Patent Trial and Appeal Board (PTAB), specifically in life science and chemical technologies. He is a frequent speaker on PTAB trial practice and he has served as an expert witness on interference practice. Hart serves on the AIPLA Special Task Force on AIA Rulemaking and he was also appointed to the six-member IPO/ABA/AIPLA Expert Committee on Regulations for Conducting New PGR/IPR Procedures (the “Gang of 6”). He is widely published in the field of intellectual property law and has provided commentary in numerous legal, business and scientific publications. Recently, Hart has spoken before clients, associations, and other audiences regarding rulemaking under the post grant provisions of the AIA. He also is an associate editor and contributing author of the ABA book, ANDA Litigation: Strategies and Tactics for Pharmaceutical Patent Litigators. As an IP Star, Hart is recognized for his work in patent interference and post-grant proceedings at the PTAB in the pharmaceutical, biotechnology, chemical, and medical device industries.
One of the firm’s co-founders, Greg Vogler focuses on patent, trade secret and trademark litigation, as well as IP due diligence related to acquisitions and mergers. His litigation experience spans diverse technologies, and he has worked extensively on medical device patent cases. In 2012, Vogler won a significant ITC trade secrets case, securing a 10-year Exclusion Order against the importation of cast steel railway wheels. He has argued over 10 times before the Court of Appeals for the Federal Circuit, and on February 5, 2013, he obtained a $70 million jury verdict for infringement of a surgical irrigator patent on behalf of Stryker Corporation against Zimmer Holdings, Inc. in Michigan. As an IP Star, Vogler is recognized for his success in IP litigation, reexaminations, due-diligence investigations, trade secrets and unfair competition matters in the healthcare equipment and services, mechanical products and processes, and medical devices industries.
George Wheeler counsels corporate clients in a wide variety of patent matters involving diverse chemical, mechanical and medical technologies, including more than 25 ex partereexaminations and several inter partes reexaminations. His specialty is patent analysis and prosecution, both for patent owners and alleged patent infringers. In 2011, he was named a Top Patent Prosecutor by PatentBuddy®, an honor achieved by only two percent of U.S. patent attorneys. Prior to McAndrews, Wheeler worked as an in-house patent attorney at The Procter & Gamble Company and Morton Thiokol, Inc.
