McAndrews, Held & Malloy Shareholder Christopher V. Carani will participate in a Stafford webinar on November 17, 2016, at Noon CT. The CLE webinar, titled “Design Patent Claim Construction: Navigating Written Description, Ornamentality, Functionality and More,” will discuss strategies to approaching these various doctrines in the context of design patent jurisprudence, including an analysis of recent court decisions.
Other panel participants include Robert Katz, attorney for Banner & Witcoff, and Nathan Sabri, associate for Morrison & Foerster in the firm’s Intellectual Property Group. The webinar will answer three primary questions:
- What key considerations should counsel keep in mind in design patent drafting?
- What steps should counsel to patent owners take to factor out functional aspects during claim construction?
- What guidance can be drawn from recent court decisions for design patent claim construction?

Carani is nationally recognized in the field of design law, which includes the protection and enforcement of product design through the use of copyrights, trade dress and design patents. He was included in IAM Magazine’s 2016 “IAM Patent 1000,” and referred to as one of the U.S.’s “pre-eminent design law experts.” He has also published and lectured extensively on the topic. Carani is on faculty at Northwestern University School of Law as an Adjunct Professor teaching IP law, and conferred his J.D. from The Law School at The University of Chicago. He holds a Bachelor of Science in Engineering from Marquette University. Away from the law, Carani is a studied jazz musician playing upright bass on the Chicago jazz circuit.
