McAndrews Shareholder Herbert D. Hart III to Speak at Bloomberg BNA’s AIA Post-Grant Patent Practice Conference

McAndrews, Held & Malloy Shareholder Herbert D. Hart III will present at Bloomberg BNA’s AIA Post-Grant Patent Practice conference, February 19-20, in Arlington, Va. Herb has significant experience in litigation before the Patent Trial and Appeal Board (PTAB), specifically in life science and chemical technologies, and has served as an expert witness on interference practice. He has recently spoken before clients, associations, and other audiences on PTAB trial practice, as well as on rulemaking under the post-grant provisions of the AIA.

Herb will participate in the panel “The Fundamentals of Post-AIA Post-Grant Patent Procedures,” which will provide a comprehensive review of the post-AIA statutes, regulations, and PTAB guidance governing Reissue, Ex Parte Reexamination, Supplemental Examination, Inter Partes and Post-Grant Reviews (including CBM Patent Reviews), Derivation and Interference Proceedings. Other panelists include:

At the two-day conference, IP attorneys and litigators bringing actions before the PTAB will receive a detailed overview of the statutory and regulatory basis for post-grant practice and how post-grant practice has evolved over its first year. There will also be mock demonstrations, for which actual Administrative Patent Judges have been invited to judge. The event will also feature luncheon addresses by Chief Judge Randall Rader and Judge Pauline Newman of the U.S. Court of Appeals for the Federal Circuit.

Herb has served on the AIPLA Special Task Force on AIA Rulemaking and he was also appointed to the six-member IPO/ABA/AIPLA Expert Committee on Regulations for Conducting New PGR/IPR Procedures (the “Gang of 6”). He is widely published in the field of intellectual property law and has provided commentary in numerous legal, business, and scientific publications. Herb is also an associate editor and contributing author of the ABA book, ANDA Litigation: Strategies and Tactics for Pharmaceutical Patent Litigators.
