McAndrews, Held & Malloy Attorney’s Article Selected for Patent Law Review 2010

CHICAGO, IL – March 10, 2010 – A patent law article by McAndrews, Held & Malloy Shareholder Christopher V. Carani has been selected as one of the 20 best law review articles of 2009 for inclusion in the Thomson Reuters (West) Patent Law Review 2010. The article explores the current state of design patent infringement law.
Carani’s article, “The New ‘Extra-Ordinary’ Observer Test for Design Patent Infringement – On a Crash Course with the Supreme Court’s Precedent in Gorham v. White,” was first published in The John Marshall Review of Intellectual Property Law at 8 J. Marshall Rev. Intell. Prop. L. 354 (2009).
Specifically, Carani’s article discusses in depth the potential tensions between recent Federal Circuit design patent decisions and the 135-year-old Supreme Court precedent in Gorham v. White. According to the article, the Gorham Court’s “ordinary observer” test, administered through the eyes of men generally, and the policy behind this test are potentially threatened by recent Federal Circuit design patent decisions. In the article, Carani provides suggestions for how these potential conflicts can be averted.
The Patent Law Review is a collection of the best articles from the past year on current critical patent law issues. Contributors include leading law professors and patent litigators and prosecutors from law firms and corporations.
