McAndrews, Held & Malloy Secures Favorable Settlement for Intercat, Inc.


 

CHICAGO, IL – February 8, 2006 – McAndrews, Held & Malloy announced today it has
secured a favorable settlement in a patent infringement case pitting its client, Intercat, Inc., against defendants W. R. Grace & Co.-Conn. and Nol-Tec Systems, Inc. The case involved catalyst-loading systems used in the process of oil refining. As a result of the settlement, Intercat will receive payments of $9 million and the right to future royalties on sales of systems which utilize Intercat’s technology. Nol-Tec is enjoined from further infringing upon Intercat’s patent.
“At stake for Intercat was the fundamental technology that launched – and currently supports – the company in a highly specialized and competitive field,” said Thomas J. Wimbiscus, McAndrews, Held & Malloy board member and lead counsel for Intercat. “We are very pleased with this settlement, which rightfully protects important intellectual property of Intercat.”
Intercat is the leading manufacturer of specialty additives and catalyst-loading systems used in the Fluid Catalyst Cracking (FCC) process, a commonly used process used by modern oil refineries to produce a high yield of gasoline and liquefied petroleum gas. Serving approximately 65 percent of the world’s additive market, the company maintains
relationships with almost every major oil refining company in the United States, Mexico,
Canada, Japan, India, Europe and Australia.
