Professional Experience
Paul’s primary focus of practice is intellectual property litigation involving patents, trademarks, trade secrets and unfair competition. He has worked on cases dealing with an array of technologies including multifocal contact lenses, industrial paper machines, cardiac defibrillators, electronic lighting systems, surgical suction-irrigators, lava lamps, beverage cans, computer jukebox technology, hospital beds, and thermoformed automotive accessories.
Paul has handled most aspects of major patent litigation including conducting pre-filing investigations, participating in every phase of discovery, claim construction procedures, motion practice, leading mediations on behalf of clients, and delivering oral arguments.
Recently, Paul served as lead counsel for the Defendant in a case involving multiple patents, trademarks and various related state claims. After taking extensive discovery, and shortly after presenting his client’s positions during mediation, the parties were able to resolve the litigation on very favorable terms.
In another suit, Paul served as litigation counsel, successfully defending against patent claims worth (according to the plaintiff’s expert witness) well over one hundred million dollars over the life of the patent. The United States District Court based its ruling on both noninfringement and invalidity. Toward that end, Paul took and defended key depositions, including deposing the plaintiff’s liability expert witness. He also participated in every other aspect of discovery and in writing the claim construction briefs and the successful summary judgment briefs.
In another recent case, in July of 2009, the U.S. District Court for the Northern District of Illinois, Eastern Division, entered an order dismissing with prejudice a patent infringement lawsuit brought against the firm’s client Bausch & Lomb Incorporated by Aspheric Lens Company. The dismissal follows a January 2009 claim construction ruling that was favorable to Bausch & Lomb. Paul participated in every aspect of the litigation, from taking key depositions, to the preparation of briefs.
Paul attended law school at the University of Notre Dame, where Paul participated in Notre Dame’s renowned Trial Advocacy Program. Paul received a Bachelor of Science degree in Physics from Elmhurst College, where Paul was awarded with Elmhurst’s Chairperson’s Award for Excellence in Physics.
