McAndrews, Held & Malloy Shareholder Sharon Hwang to Speak at Upcoming Supreme Court IP Review Conference

McAndrews, Held & Malloy Shareholder Sharon Hwang will speak at the upcoming Supreme Court IP Review (SCIPR) conference on September 22, 2016, at the Chicago-Kent College of Law. SCIPR provides intellectual property practitioners, jurists, legal academics and law students with a review of IP cases from the U.S. Supreme Court’s previous Term, a preview of cases on the docket for the upcoming Term, and a discussion of which petitions for a writ of certiorari to watch.
Hwang will participate in a panel from 10 – 10:50 a.m. CT discussing the Stryker Corp. v. Zimmer, Inc. and Halo Electronics, Inc. v. Pulse Electronics, Inc. decision. Hwang represented Stryker in all phases of the case. In June of this year, the Supreme Court sided with Stryker and Halo in a pivotal patent lawsuit over enhanced damages, ruling in a unanimous decision that the Federal Circuit’s test for awarding damages “up to three times the amount found or assessed” was overly rigid and not justified under the Patent Act. The Court’s ruling now makes it easier for patent holders to collect additional money when their inventions are copied without permission.
The Supreme Court’s decision sends the Stryker v Zimmer and Halo v Pulse Electronics cases back to the Federal Circuit for reconsideration under the new standard. Previously, Stryker and Halo were both denied enhanced damages by the Federal Circuit after winning patent infringement lawsuits.

At McAndrews, Hwang practices in all areas of intellectual property law with particular emphasis on patent litigation and intellectual property counseling. She has represented patentees and defendants in high-stakes patent litigation in federal courts and in the Federal Circuit Court of Appeals for more than 20 years. She also advises clients on the acquisition and development of intellectual property portfolios. Hwang also serves as the President of the Asian American Bar Association Law Foundation, a not-for-profit organization dedicated to supporting the public interest and community services relating to the Asian Pacific American community in the Chicagoland area. She serves on McAndrews’ Executive Committee and spearheaded the launch of the firm’s Diversity in Patent Law Fellowship, which encourages diversity in the field of intellectual property law.
