McAndrews, Held & Malloy Shareholders Aaron Barkoff and Alex Menchaca to Present at Leading Industry Conference Focused on Hatch-Waxman Litigation

McAndrews, Held & Malloy Shareholders Alejandro Menchaca and Aaron F. Barkoff, Ph.D., will present at American Conference Institute’s 4th Annual Paragraph IV Disputes Master Symposium, September 19-20, 2016, at the InterContinental Hotel in Chicago. Barkoff and Menchaca will join other patent litigators, in-house counsel, jurists and government representatives to discuss, analyze and interpret the latest trends and controversies impacting Paragraph IV litigation.

Menchaca’s panel, titled “Overcoming Obviousness in the Hatch Waxman Space: Prior Art, Obviousness, and Obvious-Type Double Patenting,” will look at the obviousness of pharmaceutical patents at the PTAB, examine the Federal Circuit’s stance on obvious-type double patenting, and evaluate recent case law and the interplay between prior art, obviousness, secondary considerations and obvious-type double patenting.

Barkoff will co-host a post-conference workshop titled “Biosimilars Boot Camp for the Paragraph IV Litigator.” BPCIA litigations are still relatively new and uncharted, and this hands-on session will walk participants through the first wave of biosimilars cases, the approval process and other key points of regulation.

Barkoff is a patent litigator who specializes in pharmaceutical and biotechnology patent law. He has impressive trial experience in Hatch-Waxman litigation, representing clients that range from the world’s largest pharmaceutical companies to smaller, generic drug companies. His strong technical background in biochemistry, combined with his deep understanding of FDA regulatory issues, allows him to assist clients with patent litigation strategy for their new products, as well as related regulatory matters. Barkoff’s counsel in relation to FDA regulations includes Orange Book patent listings, patent term extensions under Section 156 and patent certification strategies.

Menchaca’s practice includes every facet of patent, trademark and related law. He has extensive experience in litigation and prosecution of patents and trademarks, and has prepared opinions in each of these areas. He focuses on ANDA litigation and counseling. Menchaca is a recent past president of the Hispanic Lawyers Association of Illinois (HLAI) and currently serves on the HLAI/HNBA Chicago committee planning for the HNBA Annual Convention in Chicago in 2016. He is fluent in Spanish and has represented several clients who conduct business primarily in Spanish.
