Schodde, shareholder at McAndrews, Held & Malloy, Ltd., says, “One frequent concern that crops up in patent litigation, especially between competitors, is, if the companies have competing patent portfolios, obviously neither company wants the other to use not easily discernable information about their product to inform claims against pending patents they have with the United States Patent Office. Knowing the details of a competitor’s product could arguably assist in crafting claims against products still pending in the office.”
