McAndrews Held & Malloy Attorney Herbert D. Hart III to Speak at AIPLA 2015 Annual Meeting


McAndrews, Held & Malloy Shareholder Herbert D. Hart III will speak at the American Intellectual Property Law Association’s (AIPLA) 2015 Annual Meeting, October 22-24, 2015, in Washington, D.C. The event provides countless professional development and networking opportunities for nearly 2,000 attendees, who can earn up to 16.5 hours of CLE. On October 22, Hart will participate in the joint Biotechnology/International Trade Commission Committee Educational Session, which is open to all event attendees. The session will be structured as an interactive meeting among the in-house and outside counsel of the fictional biotech startup company Soteria to discuss both (1) enforcement of the company’s patents in the ITC and in district court, and (2) preparation for challenges of the company’s patents at the Patent Trial and Appeal Board.

Specifically, Hart will present on “Preparing for PTAB Challenges to Soteria’s Pre-AIA and Post-AIA Patents.” Hart is a highly-regarded and well-known PTAB trial lawyer. He regularly litigates cases before the PTAB and has done so over several decades in a wide range of technologies.

Addressing the topic “Whether to Pursue Enforcement of Soteria Bioscience’s Patents Before the ITC or District Courts” will be Brian B. Koo (US International Trade Commission), Maximilienne Giannelli (Finnegan Henderson Farabow Garrett & Dunner, LLP), and Dallin Glenn (Sterne Kessler Goldstein & Fox).

The entire session will be moderated by Vicki G. Norton, Partner at Duane Morris, LLC, and Kwame N. Mensah, Special Counsel at Medimmune.

Herbert D. Hart III regularly litigates cases before the PTAB and has done so over several decades in a wide range of technologies, with a particular emphasis on life sciences and chemical technologies. Among his successes at the PTAB have been cases involving antihistamines, oncology drugs, interventional cardiology technology, polymer catalysts and processes, hydrocarbon conversion catalysts and processes, wireless communication technology, and data encryption technology. Hart contributes to the legal profession by serving in leadership positions in all three national intellectual property law associations. He has served on the AIPLA’s Special Task Force on AIA Rulemaking and he was also appointed to the six-member Intellectual Property Owners Association/American Bar Association (ABA)/AIPLA Expert Committee on Regulations for Conducting New Post-Grant Review/Inter Partes Review Procedures (also known as the “Gang of 6”).
