Delaware Judge Sides with McAndrews Client TQ Delta

On Monday, June 28, U.S. District Court Judge Richard G. Andrews granted summary judgment of infringement to McAndrews client TQ Delta and rejected 2Wire Inc.’s cross motion for summary judgment of noninfringement. The patent at issue in Monday’s order describes a data communications apparatus that counters the effects of impulse noise, an issue for DSL technology.

TQ Delta has one of the industry’s largest DSL patent portfolios. This recent victory is one of several the company has achieved against 2Wire with McAndrews as its lead trial team. In January of last year, a Delaware jury concluded that 2Wire had infringed another one of TQ Delta’s patents and that the patent was not invalid. In 2019, another Delaware jury delivered a verdict favorable to TQ Delta on eleven counts, finding that 2Wire infringed three patents, that those patent were not obvious over prior art, and that two certificates of correction were not invalid.
