McAndrews, Held & Malloy Files Amicus Brief in Supreme Court Case

Shareholder Scott P. McBride is the Counsel of Record for the Wisconsin Alumni Research Foundation (WARF) in the patent infringement case Bowman v. Monsanto.  Scott, along with associates Stephen Wurth and Caroline Teichner, authored the amicus brief on behalf of WARF and nearly 20 other universities and groups in support of the Supreme Court affirming the Federal Circuit’s decision.  The news was covered in the January 25 IP Law360 article, “Universities Back Monsanto In High Court Seed Patent Case.” You can view the full story here.

WARF and others are so passionate about this case because the Supreme Court’s decision could potentially jeopardize some of the most innovative biotechnology research in the country. It could also alter U.S. patent law in a way that would have significant consequences for a wide variety of industries, including agriculture, medicine and environmental science, to name a few, that rely on the patent system to make their R&D investments economically viable.
