McAndrews Secures Victory for Fibar

McAndrews secured a complete victory for its client Fibar USA LLC when on June 27, 2019 Pinek IP LLC dismissed its lawsuit against Fibar in the United States District Court of the Northern District of Illinois Eastern Division. Chicago-based Fibar is a unit of wireless smart home and home automation company Fibar Group S.A. based in Poland, and Pinek is a patent holding firm based in Plano, Texas.

Pinek had alleged that Fibar infringed its U.S. Patent No. 7,233,256, which is titled “A System and Method for Receiving a Signal to Trigger a Pyroelectric Activation System.”

“When challenged by McAndrews, the plaintiff decided to dismiss its lawsuit even before an answer was submitted or a motion to dismiss was filed,” said Bartlomiej Arcichowski, Chief Technology Officer at Fibar Group S.A. “Fibar Group takes the protection of intellectual property very seriously and decided to cooperate with McAndrews, who supports us primarily in protecting our solutions and inventions, but also in cases such as the lawsuit by Pinek. We are very satisfied with the way the case was handled and supported by the McAndrews team.”

Lead attorney Anna M. Targowska explained that “The plaintiff clearly saw the writing on the wall and decided to concede what was clear to us from day one. Fibar prides itself in obeying intellectual property rights as a holder of numerous patents worldwide.
