McAndrews Shields Client Cardinal Health from Patent Infringement Charge by Kimberly-Clark

In Kimberly-Clark v. Cardinal Health, Civ. Action No. 11-1228-RGA (D. Del. 2013), a patent case relating
to surgical sterilization wraps, McAndrews’ client and defendant Cardinal Health (NYSE: CAH) resolved
its dispute against Kimberly-Clark without incurring a costly litigation and on favorable terms. McAndrews
analogized Cardinal Health to a single folded sheet of stationery (in contrast to the required two sheets
of the patent): “You don’t get two sheets of stationery by folding a single sheet in half.” After McAndrews’
attorneys argued Cardinal’s claim construction position, the case against Cardinal was dismissed with
prejudice by stipulation.
