Christopher V. Carani Presenting “Identifying the Article for Design Protection: Anticipation, Obviousness, Infringement, and Damages” at the American Bar Association’s Intellectual Property Law Section Annual Meeting

04.10.23

The annual meeting will take place April 12-14 in Washington, D.C., and Chris will discuss the impacts of recent U.S. Supreme Court and Federal Circuit decisions on Thursday, April 13 from 11:00-12:00 p.m. Eastern. Identifying the Article of Manufacture for Design Protection has drawn increased attention recently and might now more explicitly impact (i) prior art analysis for anticipation (novelty) and obviousness, (ii) infringement scope and comparison prior art, and (iii) damages from an infringer’s profit. The presentation will explore the latest developments in design patent jurisprudence, and consider design patent prosecution and litigation.
