Christopher V. Carani To Moderate Free IPLAC Webinar On Pending Federal Circuit En Banc Case LKQ v. GM, which Regards Test For Design Patent Obviousness

On Thursday, December 7 from 12:00-1:15, Christopher V. Carani will moderate a free IPLAC webinar to discuss the pending case LKQ v. GM Global, which is before the en banc Federal Circuit. The en banc court has posed several questions on review, all of which regard the fundamental question of what should be the test for assessing obviousness in the context of design patents. Chris, who co-authored the amicus brief for AIPLA along with McAndrews’ shareholder Dunstan Barnes, will be joined by four other expert panelists, all of whom have authored amicus briefs in the case. The panel will discuss the issues at play and potential outcomes. The case marks only the third time in the history of the Federal Circuit that it is applying en banc review to a design patent case, the last time being in 2008 in the landmark decision in Egyptian Goddess v. Swisa.
