McAndrews, Held & Malloy Partner Christopher V. Carani will be speaking at The Strafford Design Patent Claim Construction: Written Description, Ornamentality, Functionality and More CLE webinar Thursday, February 8th.
This CLE webinar will provide guidance to counsel on how best to navigate the tricky issues of claim construction, written description and functionality as applied to design patents. With respect to written description, on January 25, 2018, the USPTO issued new guidelines on whether the written description requirement is met in the contexts of amendment and continuation practice. The discussion will provide thoughts and advice on this fresh and controversial new topic. With respect to claim construction and functionality, the webinar will delve into both seminal and recent court decisions explore how courts are interpreting design patent claims, particularly those directed at functional items. The panelists will offer strategic advice on how to best draft claims in view of this case law.
For almost two decades, Carani has been widely known as one of the leading voices in the field of design law. In 2018, he was named one of the Top 100 attorneys in Illinois by Thomsen Reuters Super Lawyers®. He was included in IAM Magazine’s 2017 “IAM Patent 1000” as one of only a handful of thought leaders in the field of U.S design law. He has also published and lectured extensively on the topic, including service as the editor-in-chief and author of the book “Design Rights: Functionality and Scope of Protection,” which was published in September 2017 by Wolters Kluwer N.V. Carani is on faculty at Northwestern University School of Law as an Adjunct Professor teaching IP law, and conferred his J.D. from The Law School at The University of Chicago. He holds a Bachelor of Science in Engineering from Marquette University.
