Peter J. McAndrews is a Shareholder at McAndrews and practices in all areas of intellectual property and complex technology law. He has been involved in all aspects of patent litigation, acquisition and counseling, involving a broad spectrum of electrical, biomedical and mechanical technologies.

Peter is a US Patent and Trademark Office-to-Appeals Court patent attorney and litigator who helps his clients secure intellectual property rights, make smart decisions with those rights and litigate, if necessary, to vindicate those rights. Most recently, he has worked with clients with technologies in the fields of wireless and wireline communications, including cellular, digital subscriber line (DSL), fiber optics, and Wi-Fi; computer engineering and computer science, including accelerators and cryptography; and food and beverage packaging.

Peter is known for a rigorous fact- and science-based approach to his advocacy, grounded in his ability to thoroughly grasp relevant technologies in order to identify accurate, and therefore effective, arguments. Rather than attempting to “sell a story” Peter believes that judges and juries, even if they fail to fully understand technical content, can sense when they hear the truth, and will react accordingly.

He has litigated patent disputes involving wired and wireless networks, cardiac pacemakers and defibrillators, thermal hand-held labelers and printers, digital television distribution systems, ophthalmic surgery systems, pneumatic actuators, paper-making machinery, cellular and IP telephony, fiber optics, Internet applications and computer software. He has also litigated trademark, trade dress and unfair competition issues. Peter also has significant experience in emerging areas of the law, such as inter partes reviews, or the quickly evolving law relating to litigation of standard-essential patents (e.g., patents that are necessarily infringed when a device complies with a standard such as a Wi-Fi or cellular or DSL standard) and a patent owner’s commensurate obligation to license such patents on (Fair), Reasonable and Non-Discriminatory, or (F)RAND terms.

Ranging from ultrasound medical equipment to semiconductors, Peter has managed the development of significant global patent portfolios and has prepared and prosecuted numerous patent applications for inventions in many diverse fields. He advises clients regarding patent infringement/non-infringement and validity/invalidity for both utility and design patents. He also performs due diligence investigations for the acquisition of multi-million-dollar companies.

Peter has received significant professional recognition for his abilities as a patent attorney. He was recently ranked by Patexia as tenth in their nationwide list of “Top 50 Best Performing Attorneys representing Patent Owners” in inter partes review proceedings before the Patent Trial and Appeal Board with a 90.4% performance rating over the time period of July 2013-June 2018.  He also received a 100% performance rating when representing Petitioners. Additionally, he has been recognized as a World Intellectual Property Review Leader for each year (2016-2019) that the list has been published.
