Philipp Ruben PartnerPhilipp Ruben is a Partner at McAndrews, where he focuses his practice on intellectual property (IP) litigation and prosecution. Philipp has significant experience protecting design rights, including drafting and prosecuting design patent applications, design-arounds, counseling clients on design patent portfolios and conducting infringement/invalidity opinion work, and due diligence investigations. Philipp brings over a decade of federal court experience, representing clients in complex patent and copyright disputes across a broad range of industries. As a seasoned litigator, he has taken on all phases of IP litigation, from pre-filing investigation and claim analysis through discovery and dispositive motion practice. Philipp’s practice encompasses pre-filing infringement and validity assessments, complaint drafting and early case strategy, claim construction and Markman proceedings, fact and expert discovery, inter partes review and post-grant proceedings before the USPTO, and dispositive motion practice, including summary judgment, in federal district courts nationwide. Philipp also has extensive experience in negotiating out-of-court resolutions to various IP disputes, including guiding clients through mediation and arbitration. He approaches every dispute with an eye toward early resolution opportunities that minimize client cost and business disruption. Once a resolution is reached, Philipp has significant experience in drafting comprehensive settlement agreements tailored to the specific IP rights at issue, ensuring that negotiated outcomes are fully enforceable and memorialized with precision. As a practitioner, Philipp is particularly gifted at grasping the intricacies of complex products and technologies quickly. Especially with respect to mechanical technologies, he has a very strong technical understanding of function, manufacture, and operation. This capability is frequently brought to bear in his various opinion work, particularly when providing detailed non-infringement opinions. He has a special facility for creating succinct, effective visual opinions. Philipp graduated summa cum laude from DePaul University College of Law, where he was the President of the Intellectual Property Law Society and an active member of the Appellate Moot Court Society. In addition, Philipp served as a judicial extern for the Honorable Amy J. St. Eve of the United States District Court for the Northern District of Illinois. During law school, Philipp received the Intellectual Property Legal Writing Award for his work in his IP-focused legal writing courses. He was inducted into the Order of the Coif in 2016.
